Terms & Conditions of use of AFC Media Channel.

Please read these terms carefully.

The Asian Football Confederation (hereinafter referred to as AFC) is responsible for maintaining the AFC Media Channel on www.the-afc.com in order to provide users with information pertaining to its products and services as well as general information regarding all its competitions.

The user hereby acknowledges and agrees that using browsing or registering on the AFC Media Channel for the purposes of assessing information and details as well as services offered herein, the user is deemed to have both read and agreed to all the terms and conditions of this AFC Media Channel, notification of confidentiality and disclaimers.

AFC shall not be held liable for any damages of any kind arising from the use of this AFC Media Channel, including but not limited to direct, indirect, incidental, special, punitive and consequential damages.

COPYRIGHT

All content include on www.the-afc.com such as text, graphics, logos, button icons, images, audio clips, digital downloads and data compilations is the property of AFC or it's official media partners and protected by Malaysian Laws and international copyright laws. All software used on www.the-afc.com is the property of AFC or its software suppliers and protected by Malaysian laws and international copyright laws.

RESTRICTIONS ON USE OF MATERIALS

All information materials and marks displayed on the AFC Media Channel and/or www.the-afc.com is confidential, is protected by intellectual property laws and is restricted to utilization for information purposes only. Any unauthorized copying, reproduction, transmission, distribution, dissemination, sale, publication or exploitation of the displayed material would constitute an infringement of the protection afforded by law and is therefore prohibited in any form whatsoever. Modification of any of the materials or use of the materials for any other purpose will be a violation of AFC's rights.

The user acknowledges that AFC own the Trademarks for the Competitions and that they may not be used outside the relevant graphic guidelines or without prior written permission. Where permission is granted, users must still strictly follow the trademark guidelines as provided by AFC. The use of any Trademarks or other marks owned by AFC shall include the appropriate copyright notices and/or trademark legend(s) as instructed by AFC in writing.

Any materials taken by the user from the AFC Media Channel for purpose of publishing and/or circulation either by way of the local and/or international dailies and/or broadcast stations must include all copyright and other proprietary rights notices in the same form in which the notices appear in the service, original source attribution, and the phrase Use with permission from the www.the-afc.com or Asian Football Confederation. Please consult with AFC if you need to distribute an article from a service to a larger number of individuals on a regular basis or in any other manner not expressly permitted by this Agreement.

NO REPRESENTATION

This AFC Media Channel and all content on www.the-afc.com has been compiled in good faith by AFC, but no representation is made or warranty given (either express or implied) as to the completeness or accuracy of the information it contains.

Whilst every effort is made to represent accurate information on ongoing basis, inadvertent errors and typographical inaccuracies may occur. Information, laws, rules and regulations may also change from time to time. Information contained on the AFC Media Channel is therefore made available without any express or implied representation or warranty whatsoever, AFC disclaims liability for any expense incurred, or any damage or loss sustained which may be attributable, directly or indirectly to the use of or reliance upon any information, links or services provided through the AFC Media Channel and emanating from either contract, derelict or statute.

No representation, warranty, undertaking or guarantee of any nature is made or given concerning the accuracy and/or completeness of such information nor the accuracy of any opinions expressed.

AFC reserves the right to alter and update information from time to time, without prior notification on the AFC Media Channel, in order to correctly reflect such information.

FORMALITIES OF TRANSACTION AND JURISDICTION

All services offered by AFC Media Channel are subject to the completion of the requisite application forms and formalization of the transaction, which are to be approved by AFC.

MEDIA REGISTRATION OBLIGATIONS

In consideration of the use of the service of the AFC Media Channel, the user undertakes to provide true, accurate, current and complete personal information as prompted by the services registration/application form and to maintain and promptly update the information by keeping AFC apprised of all changes in personal particulars.

We allow you to register on the site on the basis that: -

Your username and password are personal to you and may not be used by anyone else.

You do not maliciously create additional usernames for the purpose of abusing the functionality of the site, or other users, nor do you seek to pass yourself off as another user by adopting a similar username.

You comply with these terms and conditions

If, for any reason, AFC believes you have not complied with these requirements we may, at our discretion, cancel your registration immediately and without giving you any advance notice.

SUSPENSION AND TERMINATION OF ONLINE FACILITIES

AFC shall at all times and for any reason whatsoever, have the sole and exclusive rights at its discretion to suspend or terminate the online facilities without any prior notification or providing any reasons for such suspension or termination. Without prejudice to the aforesaid, AFC shall not exercise its rights in terms of this clause without just cause.

BREACH AND CANCELLATION

Any breach by the user of any nature whatsoever of these express or implied online terms shall entitle AFC to immediately terminate the application/agreement without prior notice. Termination of the application/agreement shall in no way affect AFC's right to enforce any of its rights pertaining to the online terms, common law or statute.

CONFIDENTIALITY

Users are advised that use of the Internet as a form of communication is not yet completely secure and information transmitted via the internet as medium of communication may be intercepted, accessed and or read by third parties. The user bears all risk of transmitting their confidential information via this medium and no liability shall attach to AFC for any loss, harm or damage suffered as a result of any leak of confidential information to a third party or any other source. AFC reserves the right to request independent verification of any information transmitted via the AFC Media Channel or by email.

USER NAME AND PASSWORD

The user understands and accepts that he/she is responsible for all use of online facilities made using his/her username and password, irrespective of whether the user has authorized a third party and permitted access to his/her username and password. Should the user suspect that there has been a breach of security and/or unauthorized use of the username and password, this concern is to be communicated to AFC without delay.

AFC may, in its sole discretion and for any reason whatsoever, require the user to change the user identity and/or password from time to time to facilitate unconditional compliance with company security requirements.

The AFC Media Channel shall not under any circumstances be held liable for any actions taken on unauthorized instructions.

GOVERNING LAW AND JURISDICTION

The formation, existence, construction, performance, validity and all aspects whatsoever of these terms and conditions or of any term of these terms and conditions shall be governed by the Laws of Malaysia. You agree that this Agreement, as well as any and all claims arising from this Agreement shall be governed by the Laws of Malaysia without regard to any conflict of law principles.

In the event that the parties have a dispute over any term or otherwise relating to this terms and conditions they shall use their best endeavours to resolve it through good faith negotiations without recourse to the law. Where recourse is not reached within fourteen (14) days then the matter shall be submitted to Arbitration in accordance with the Singapore International Arbitration Commission.

PERSONAL DATA PRIVACY

By registering and accessing the AFC Media Channel, the user acknowledges and accepts that AFC shall obtain personal information. This information shall be used for processing your request, sending you the information you have requested, providing you with games related information and for auditing usage of the site. Users are also advised that by registering with this AFC Media Channel, AFC shall have the discretion to use and give any data obtained to third parties which are directly connected with AFC. Such disclosure where necessary will only be given under strict guidelines as to what use may be made of such details.

AFC will contact the users and keep users updated about all its competitions, activities and any other related competition information.

SUGGESTIONS, COMMENTS AND FEEDBACKS

Any communication you send to this AFC Media Channel or otherwise to AFC by electronic mail are on a non-confidential basis, AFC is under no obligation to refrain from reproducing, publishing or otherwise using them in any way for any purpose, including the developing, manufacturing and/or marketing of goods or services. Further, AFC shall be free to use any ideas, concepts, know-how or techniques contained in such information for any purpose whatsoever including but not limited to developing and marketing services incorporating such information.

THIRD PARTY AFC MEDIA CHANNELS, SERVICES AND SOFTWARE

We may link to, or promote services from other companies or offer you the ability to download software from other companies. You agree that we are not responsible for, and do not control, those services and software.
